Contra Costa and Alameda Counties
Many families and individuals in California are being negatively affected by today's slowing economy. Additionally, record fuel prices, dropping home values, increased unemployment and other unforeseen financial debts are placing an intolerable burden on many citizens throughout Contra Costa and Alameda Counties. Many families are losing their homes because they are upside down on their first and second mortgages. We can help!
At The Cerda Law Offices, we understand and sympathize with those facing mounting financial burdens. We are here to help you get control of your financial life and provide stability for your future. We can stop harassing calls from creditors and collection agencies, stop foreclosures and wage garnishments. You can keep your home and we can eliminate your second mortgage or line of credit. We can help alleviate the stress you are going through and provide a light at the end of the tunnel.
Still, many individuals have questions and concerns about how a bankruptcy filing will affect their homes, their cars, taxes, judgments and student loans. Each state has different laws to exempt certain property from being taken in a bankruptcy filing. We can answer your questions, help you understand how the law applies to your individual situation, and advocate for you every step of the way.
In addition to supporting clients through the Chapter 7 and Chapter 13 bankruptcy process, we also advocate relentlessly on behalf of individuals and families who are under the threat of foreclosure on their homes. Your home is your most precious asset. We can help you protect it.
Do I Need a Bankruptcy Attorney?
Bankruptcy is now more complicated than ever. Congress passed the most sweeping reform bankruptcy laws in 2005, so the decision of whether to file and selecting the best process for you requires planning with a bankruptcy attorney. Your lawyer's advice can make a big difference as to how much property you may be able to keep and how much debt you can eliminate. Your attorney can help you take advantage of all the relief provided by the United States Bankruptcy Code.
At The Cerda Law Offices, we can help you through this difficult process, and our knowledge can make a difference in your case. If you have suffered from major medical expenses, a devastating judgment, or a business failure, bankruptcy relief may be an option for you. If a financial disaster has led to a pending foreclosure, collection lawsuit, or wage garnishment, we can advise you in choosing whether to reorganize your finances or discharge your debts.
Fees & Payment Plans
It is extremely inexpensive to hire an attorney to file Bankruptcy when compared to your other options - which include simply paying all of your bills. A bankruptcy attorney can help you correctly list all of your obligations and help you keep as much property as possible and eliminate as much debt as possible. If you file the paperwork incorrectly or use an unlicensed, non-attorney, the problems you may face could exceed the cost of a bankruptcy attorney.
To file a bankruptcy case, there are basically two costs:
- A filing fee paid to the United States Bankruptcy Court; AND
- Legal fees to your bankruptcy attorney
At The Cerda Law Offices we have flat fees that will cover the work on your entire case. Bankruptcy attorney fees are based on a number of factors and all cases are different. We want to base your fees only on the work we will have to perform on your case.
To determine an appropriate bankruptcy attorney fee we ask that you complete a questionnaire, so that we can better understand your financial situation. The less complicated your bankruptcy case is, the lower your attorney fees will be. And, after your fees are determined in advance, you will know for sure the total cost of our services before we file your case.
Bankruptcy Courts require that legal and filing fees be paid before your Chapter 7 case is filed in court. While you cannot pay for your own bankruptcy case with your own credit card, we do accept credit card payments from other people who are willing to pay for your bankruptcy attorney fees. Friends and family members sometimes can help, but they must give you the money for the fees - not simply loan you the money.
